Higher Ethics - no Dual Agency
An example of the higher standard you can expect from SimplySOLD is our rejection of dual agency. In Arizona, a real estate agent or broker has a fiduciary duty to his or her client. Fiduciary duty is the highest duty in law, it requires that an agent treat a client with "the utmost good faith". What does that mean practically?
For the seller, the agent must attempt to: get the seller the highest price, and the most favorable terms, with the smallest possible chance of litigation or liability to the buyer.
For the buyer, fiduciary duty requires that the agent attempt to: get the lowest price, and the most favorable terms, with the smallest possible chance of litigation or liability to the seller.
Dual agency means representation of both sides. In other words, dual agency allows the agent or the broker to represent both the buyer and seller. If both the buyer and seller are clients, the agent owes a fiduciary duty to both. But the interests of the buyer and seller, as summarized above, are in conflict - because they both have goals that are mutually exclusive.
How, then, can an agent discharge the duty of utmost good faith to both sides simultaneously? The short answer is that he or she can't. Although this appears obvious, dual agency is allowed by the Department of Real Estate (some say that is due to political pressure by the large brokerages who make a lot of money from dual agency transactions).
Dual agency is, in reality, impossible. The real estate licensee "can't serve two masters", or in this case, the buyer and the seller, at the same time. Universally condemned, many states have outlawed dual agency, prompted by concerns that it creates an inherent conflict of interest. All consumer advocacy organizations that have commented on the issue agree: consumers are being hurt by dual agency and should insist on exclusive representation.
Why do agents engage in dual agency and its obvious conflict of interest? They want to represent both the buyer and seller simultaneously so they can "double dip" - get the commission payable to the seller's agent and the buyer's agent. By doing so, they are putting their wallet ahead of your best interest.
As a result, buyers and sellers should insist that their agent have an exclusive fiduciary duty to them and that the agent place the interests of the client over the goals of that of the other side. Require your real estate licensee to do what you no doubt assume they should be doing in the first place: putting your interest first.

Do you think the choice of real estate agent won't affect your ability to win your case if a buyer or seller defaults?
